1. 1 Agreement to Terms

   By using this website or buying a Gekke Ontwerpen product, you agree to these Terms of Service. If you do not agree, do not use the site or make a purchase.

2. 2 Who We Are

   Gekke Ontwerpen is a clothing brand based in Morocco. We design for, and sell to, customers in the Netherlands, Germany, and the rest of Europe. You can reach us at [email protected].

3. 3 What We Sell

   We sell clothing with our own designs, starting with T-shirts, in limited drops. When a design is sold out it may not come back. All products are physical items that are shipped to you.

   We describe and photograph our products as accurately as we can. Colours can differ slightly between screens and real fabric, and sizes can vary by a centimetre or two.

4. 4 Ordering and Eligibility

   • Our website shows the collection. Checkout takes place on Etsy, and Etsy's own terms apply to the purchase alongside these Terms.
   • You must provide accurate information when ordering, including a delivery address where the parcel can actually arrive.
   • You must be legally able to enter into a binding agreement in your country, or have the permission of a parent or guardian.
   • We may refuse or cancel an order we reasonably suspect is fraudulent, or that is affected by an obvious pricing or stock error. If we do, you are refunded in full.

5. 5 Prices and Payment

   • Prices are shown in euros and include VAT (btw) where it applies.
   • Delivery costs are shown before you pay.
   • Prices may change, but the price you pay is the price shown at the time of your order.
   • Payment is processed by Etsy Payments. An order is confirmed once payment has gone through.

6. 6 Shipping and Delivery

   • Expected production and delivery times are stated on each listing. They are estimates, and we will tell you if something is delayed.
   • Risk of loss or damage passes to you when the parcel is delivered to you or to someone you have named.
   • Depending on where your order ships from, your country may charge import duties or taxes on delivery. Where that applies, they are your responsibility unless the listing says they are included.

7. 7 Returns and Refunds

   Returns, replacements, and refunds are covered by our Refund Policy, which forms part of these Terms.

8. 8 Designs and Intellectual Property

   Every design, illustration, photo, text, and the Gekke Ontwerpen name and logo belong to us. Buying a product makes you the owner of that item, not of the design printed on it. The details are in our End User License Agreement (EULA).

9. 9 Prohibited Use

   • Copying, reprinting, or selling our designs, or products that imitate them.
   • Using the website in a way that damages it, overloads it, or attempts to access parts of it that are not meant for you.
   • Attempting to defraud the store, for example through false claims of non-delivery or payment disputes on orders that arrived as described.

10. 10 Limitation of Liability

    You have the legal guarantee that a product must be as described and fit for normal use, and nothing in these Terms takes that away. Beyond those rights, and to the maximum extent permitted by law, we are not liable for indirect or consequential damages arising from the use of our products or website. We are also not responsible for the reactions of strangers to what your shirt says.

11. 11 Governing Law

    These Terms are governed by the law of Morocco. If you are a consumer living in the European Union, you keep the mandatory consumer protections of the law of your own country, and nothing in these Terms takes them away.

12. 12 Changes to These Terms

    We may update these Terms from time to time. The version in force when you place an order applies to that order.
